Acceptable Use Policy

This policy sets out the rules governing how RecallIQ subscribers may use the platform. By subscribing, you agree to comply with this policy in full. Breach of this policy may result in immediate suspension of your account.

1. Your Responsibility for Customer Data

As a subscribing garage, you are the Data Controller for all customer personal data you upload to RecallIQ. This means you are legally responsible for:

  • Ensuring you have a lawful basis under UK GDPR to use customer mobile numbers for SMS reminders (legitimate interests or consent)
  • Having informed customers that their data may be used to send service and MOT reminders via SMS
  • Maintaining accurate, up-to-date records and removing customers who have opted out
  • Ensuring all data uploaded relates to genuine customers of your business only

⚠️ You must not upload customer data belonging to another business, purchase third-party marketing lists, or upload data for any purpose other than genuine MOT/service reminders for your own customers.

2. Permitted Use

RecallIQ may only be used to:

  • Send MOT and vehicle service due date reminders to your own customers
  • Send Google Review requests to customers following a completed job at your garage
  • View analytics and reporting relating to your own reminder campaigns
  • Manage your customer database within the RecallIQ platform

3. Prohibited Use

You must not use RecallIQ to:

  • Send unsolicited marketing messages unrelated to MOT or vehicle servicing
  • Upload personal data that you do not have a lawful basis to process
  • Send messages to individuals who have previously opted out or requested erasure
  • Impersonate another business or send messages under a false garage name
  • Harvest, scrape, or share customer data obtained through the platform
  • Use the platform for any purpose that violates UK GDPR, PECR, or any applicable law
  • Attempt to reverse engineer, copy, or resell the RecallIQ platform or its underlying technology

4. Opt-Out Compliance

Every SMS sent through RecallIQ includes a STOP opt-out instruction. You must:

  • Never contact a customer who has replied STOP to any RecallIQ message
  • Remove opted-out customers from your RecallIQ account promptly
  • Honour opt-out requests made directly to your garage within 10 business days

RecallIQ automatically suppresses opted-out numbers at the platform level as an additional safeguard.

5. Legitimate Interests Assessment

RecallIQ recommends that subscribing garages conduct and document a Legitimate Interests Assessment (LIA) covering the use of customer mobile numbers for service reminders. This assessment should confirm:

  • The purpose is genuine and proportionate (reminding your own customers of booked or due services)
  • Customers would reasonably expect to receive such reminders from their garage
  • A clear opt-out mechanism is provided in every message

6. Data Accuracy

You are responsible for ensuring that customer records are accurate. RecallIQ is not liable for messages sent to incorrect mobile numbers resulting from inaccurate data uploads. Please verify customer contact details before importing.

7. Enforcement

RecallIQ reserves the right to:

  • Suspend or terminate any account found to be in breach of this policy without notice
  • Report suspected unlawful use to the Information Commissioner's Office (ICO) or other relevant authorities
  • Seek recovery of any costs, fines, or damages arising from a subscriber's breach of this policy
